THIS MEETING WILL BE HELD IN-PERSON in accordance with the Ralph M. Brown Act and limitations prescribed by State law. To maximize transparency and public access, while the primary meeting takes place in the Millbrae City Council Chambers location, members of the public may attend in person at the Millbrae Council Chamber, at the teleconference location by Zoom or by phone. If technical issues arise with Zoom or the phone dial-in option, the Planning Commission meeting will continue unless the meeting is being held pursuant to the provisions of Assembly Bill 2449 for appointed Commissioners. The meeting will be broadcast live on the Millbrae Community Television Cable Channel 27 or on www.mctv.tv.

Members of the public are encouraged to provide comments.  To maximize time for public comment, speakers are subject to a 3-minute time limit unless otherwise determined by the Chair.

We wish to pay our respects to the Ancestors and Relatives of the Ramaytush Community and to affirm their sovereign rights as First Peoples. We recognize that the Ramaytush Ohlone have lived in harmony with nature for millennia, and that to achieve a truly ecologically sustainable future for Millbrae, we must embrace Indigenous traditional ecological knowledge in how we care for the city’s lands, waters, and all its people. Reserved for persons wishing to comment on any item not appearing on the agenda.  Public Communication is limited to no more than thirty (30) minutes, with each speaker given no more than three (3) minutes. If more than ten (10) speakers are present, speakers’ time shall be reduced so that all speakers have an equal time to speak. Although we welcome and encourage public communication, the views or information presented by the speakers are not necessarily the views of the Council or the members of the public in Millbrae.

NOTICE TO THE PUBLIC:  Persons who wish to speak on matters set for PUBLIC HEARING will be heard when the presiding officer calls for comments from those persons who are in support of or in opposition thereto.  After oral testimony has been given, the hearing is closed unless continued to another time, and brought to Planning Commission level for discussion and action. Normally no further oral testimony is permitted unless requested and allowed by the Planning Commission.

a) 105 North Rollins Road (APN #024-181-090): A public hearing on a CONDITIONAL USE PERMIT application to allow a bank use, Liberty Bank, in the Millbrae Station Area Specific Plan Transient Oriented Development (TOD) Zoning District - ACTION 

The project is categorically exempt pursuant to CEQA Guidelines Section 15301 Existing Facilities (Class 1) because the request is for the leasing of a private structure with no expansion of the former use.

 b) 1343 Terrace Drive (APN #021-011-540): A public hearing on a DESIGN REVIEW PERMIT application to allow the demolition of an existing single-family residence and the construction of a new 5,510 sf two-story single-family residence and an EXCEPTION request to allow the project to exceed the maximum allowed FAR and an exception to the upper story side setback, in the Single-Family Residential (R-1) Zoning District – ACTION 

The project is categorically exempt pursuant to CEQA Guidelines Section 15303 New Construction or Conversion of Small Structures (Class 3) because the construction is for one single-family residence in an urbanized area and the area in which the project is located is not environmentally sensitive.

c) 959 El Camino Real (APN #021-364-080): A public hearing on a MASTER SIGN PROGRAM for a mixed-use development in the Corridor Mixed Use (CMU) Zoning District – ACTION 

The project is categorically exempt pursuant to CEQA Guidelines Section 15301 Existing Facilities (Class 1) (g) which exempts the installation and alteration of on- and off-premises signs.

 d) Downtown and El Camino Real Specific Plan and Land Use Designations Map Amendment: Amendment to the Downtown and El Camino Real Specific Plan and Land Use Designation Map (Figure 5.1) and supporting text to amend the Commercial Preference Area overlay and to extend the overlay to include five Corridor Mixed Use zoned parcels at the corner of El Camino Real and Center Street and all Residential Focused Mixed Use zone parcels along El Camino Real north of Meadow Glen Avenue. - ACTION 

A General Plan Environmental Impact Report (EIR), which included the Downtown and El Camino Real Specific Plan, was certified in 2022.  Pursuant to CEQA Guidelines section 15162: 1) there are no substantial changes proposed in the project which will require major revisions of the previous General Plan EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects;   2) there are no substantial changes with respect to the circumstances under which the amendment is undertaken which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and 3) no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was adopted, shows any of the following:

    1. The project will not have one or more significant effects not discussed in the previous EIR; 
    2. Significant effects previously examined will not be substantially more severe than shown in the previous EIR; 
    3. There are no mitigation measures previously found not to be feasible which would in fact be feasible and would not substantially reduce one or more significant effects of the project; or 
    4. There are no mitigation measures which are considerably different from those analyzed in the previous EIR that would substantially reduce one or more significant effects of the environment.
